These Promotional Terms govern sweepstakes, contests, giveaways, drawings, and other promotional offerings ("Promotions") run by Persona Payments LLC, dba Fansit, with a registered place of business at 1309 Coffeen Ave STE 1200, Sheridan, WY 82801. They are in addition to the Terms of Service and any official rules published for an individual Promotion ("Official Rules").

If anything in the Official Rules of a specific Promotion conflicts with these Promotional Terms, the Official Rules control for that Promotion.

1. Eligibility

1.1. Unless an individual Promotion's Official Rules state otherwise:

Open only to legal residents of jurisdictions where the Promotion is not prohibited by law.
Open only to individuals who are 18 years of age or older and the age of majority in their jurisdiction.
Closed to employees, officers, contractors, and immediate family members of Fansit, its affiliates, and any prize providers.

1.2. Where required by law, Fansit will exclude residents of jurisdictions in which a Promotion is prohibited (e.g., Quebec, certain U.S. states for skill contests, etc.).

2. No Purchase Necessary (Sweepstakes Only)

2.1. Sweepstakes are decided by chance. Where required by law, sweepstakes will provide a free, equally-weighted method of entry that does not require a FanBuck purchase or any other consideration. The free-entry method, if required, will be set out in the Official Rules of the specific sweepstakes.

2.2. Contests may be decided by skill (judging criteria) and may require an entry fee or qualifying activity, subject to applicable law.

2.3. The Official Rules will state clearly whether a Promotion is a sweepstakes (chance) or a contest (skill).

3. How to Enter

Entry methods, entry windows, entry caps, and any required actions are set out in the Official Rules for each Promotion.

4. Prizes

4.1. Prize details — including approximate retail value (ARV), quantity, fulfillment method, and substitution policy — are set out in the Official Rules.

4.2. Prizes are non-transferable. Fansit may, at its sole discretion, substitute a prize of equal or greater value if the original prize becomes unavailable.

4.3. Tax responsibility. Winners are solely responsible for all federal, state, and local taxes on prizes received. Fansit will issue Form 1099-MISC to U.S. winners receiving prizes valued at $600 USD or more in a calendar year.

5. Winner Selection & Notification

5.1. Winners are selected as described in the Official Rules.

5.2. Fansit will attempt to notify winners through their Fansit account email and in-Platform notifications. If a winner cannot be reached within seven (7) days of selection, or if a winner is ineligible or fails to comply with these Promotional Terms or the Official Rules, an alternate winner may be selected.

5.3. Winners may be required to sign and return an affidavit of eligibility, liability/publicity release, and IRS Form W-9 (or equivalent) before receiving a prize.

6. Use of Winner Information

6.1. By entering a Promotion you consent to Fansit's use of your account display name, username, city/state of residence, and prize information for promotional purposes worldwide, in any media now known or later developed, without further compensation, except where prohibited by law.

6.2. You may opt out of public-facing announcement of your name only by declining the prize before acceptance.

7. General Conditions

7.1. Fansit reserves the right to cancel, suspend, or modify any Promotion in whole or in part if fraud, technical failure, or any other factor beyond Fansit's reasonable control impairs the integrity of the Promotion.

7.2. Fansit reserves the right to disqualify any entrant who tampers with the Promotion, violates these Promotional Terms or the Official Rules, or acts in an unsportsmanlike or disruptive manner.

7.3. Limitation of liability. Without limiting Terms § 14, entrants release Fansit from all claims arising from participation in any Promotion, prize receipt, or prize use, to the fullest extent permitted by law.

8. Disputes

Any disputes related to a Promotion are governed by the dispute-resolution provisions in Terms § 15, including mandatory arbitration and the class-action waiver, except as otherwise required by applicable law.

10. Where Required by Law

For Promotions in which the Official Rules call for a Winners List or Official Rules to be sent by mail, send a self-addressed stamped envelope to the mailing address above with the Promotion name and a request for "Winners List" or "Official Rules" no later than the deadline stated in the Official Rules.
