Standard Contract Between Fan and Creator

This Standard Contract (the "Agreement") governs each individual transaction between a User ("Fan") and a Creative User ("Creator") on the Fansit platform. It outlines the mutual rights and obligations of both parties in connection with accessing and licensing Creator content.

This Agreement supplements the General Terms & Conditions, Acceptable Use Policy, and all other applicable Fansit Policies.

1. Definitions

  • "Fan" means a registered User who makes a payment to Fansit in exchange for a license to view Creator content.
  • "Creator" means a Creative User who uploads content to the Platform and grants a license to Fansit to distribute that content.
  • "Transaction" means any payment made by a Fan in connection with a Creator's Paid-for Services, including subscriptions, tips, pay-per-view purchases, and custom content requests.
  • "Fan Payment" means the total amount paid by a Fan in respect of a Transaction.
  • "AI Creator" means a Creator whose account has been designated as featuring AI-generated content under the AI Creator Terms of Service.

2. Transaction Terms

2.1. All Transactions are processed through Fansit. For tax, legal, and regulatory purposes, all payments are made to Astartus LLC, which determines and pays earnings to Creators according to the Creator Earnings & Payout Policy.

2.2. Upon completion of a Fan Payment, Fansit grants the Fan a non-exclusive, non-transferable, non-sublicensable, and revocable license to view the specific content to which the Transaction relates.

2.3. This license:

  • Is limited to personal, non-commercial viewing through the Platform;
  • Does not permit downloading, reproducing, distributing, or publicly displaying the content;
  • Allows temporary caching where technically necessary.

2.4. No ownership or intellectual property rights transfer to the Fan under any circumstances. All rights remain with the Creator and/or Fansit.

3. License Expiration

3.1. The Fan's license to view content will expire immediately, without notice, in the following situations:

  • The Fan Payment is unsuccessful, reversed, or charged back;
  • In the case of subscriptions, at the end of the subscription term unless renewed;
  • The Fan's Account is terminated or suspended;
  • The Creator removes the content from the Platform;
  • Fansit removes the content for policy or legal compliance reasons.

4. Creator Obligations

4.1. The Creator:

  • Accepts responsibility for the accuracy, legality, and ongoing availability of the content;
  • Retains ownership of all content and is responsible for licensing terms;
  • Agrees that their earnings are governed by the Creator Earnings & Payout Policy.

4.2. Where a Creator is an AI Creator, the Fan will be informed of this status through the Platform's AI Creator badge and labeling system prior to completing a Transaction.

5. Cancellation and Refunds

5.1. By entering into a Transaction, the Fan consents to the immediate supply of digital content and waives any statutory cancellation rights under the Consumer Rights Act 2015 or similar legislation.

5.2. This does not affect the Fan's rights to request a refund where required by law.

6. No Warranties

6.1. Neither Fansit nor the Creator warrants or guarantees:

  • Continuous access to content (which may be removed at the Creator's discretion or as required by law);
  • The frequency, quality, or volume of new uploads by a Creator;
  • The compatibility of content with the Fan's preferences or devices.

6.2. Content is made available as-is, with no warranty or entitlement beyond the access license described in this Agreement.

7. Disputes

7.1. Disputes between Fans and Fansit shall be resolved in accordance with the Complaints Policy.

7.2. Disputes between Fans and Creators relating to content quality, availability, or expectations should first be directed to the Creator. If unresolved, the Fan may submit a complaint to Fansit.

7.3. You agree to release Fansit from any and all claims, disputes, or liabilities arising from transactions with Creators.

8. Governing Law

8.1. The governing law and jurisdiction clauses are as set out in the General Terms & Conditions.
