Creator Terms

These Creator Terms ("Creator Terms") apply in addition to the Terms of Service when you use Fansit as a Creator. By enabling Creator features on your account, you agree to be bound by both. Capitalized terms not defined here have the meanings given in the Terms of Service. "Fansit" means Persona Payments LLC, a Wyoming LLC, doing business as Fansit, with a registered place of business at 1309 Coffeen Ave STE 1200, Sheridan, WY 82801.

1. Eligibility

To become a Creator, you must:

  • Be at least eighteen (18) years of age.
  • Hold a verified Fansit account.
  • Complete identity and age verification through our verification provider, Incode Technologies, Inc. (See Age Verification Policy.)
  • Not be barred from operating an account under any applicable law or sanctions program.
  • If operating as an AI Creator, comply with Section 8 below.

2. Content Ownership & Licensing

2.1. You retain ownership of original content you create and upload.

2.2. By uploading content, you grant Fansit the licenses described in Terms § 6, including the worldwide license to host, distribute, and process your content for Platform operations and the §2257 retention exception.

2.3. License to Fans. When a Fan purchases or unlocks your content, the Fan receives a perpetual, personal, non-transferable, non-sublicensable license to view that specific piece of content for personal, non-commercial use, even if you later remove it or close your account. You may not retroactively revoke a Fan's access to content they have already paid for.

2.4. You represent and warrant that you own or have all necessary rights, licenses, consents, and releases for every piece of content you upload, including from every individual depicted.

4. Payments & Earnings

4.1. Earnings, payout schedule, chargeback handling, minimum thresholds, and tax reporting are governed by the Payout Policy.

4.2. You acknowledge that:

  • FanBuck pricing for Fans and the Creator cash-out rate are set by Fansit and may change at any time.
  • Tips are non-refundable gratuities (Terms § 4.4).
  • Pay-per-view purchases grant Fans a permanent license (Section 2.3).

5. Taxes

5.1. You are an independent contractor, not an employee, agent, partner, or joint venturer of Fansit. Nothing in these Creator Terms creates an employment, agency, partnership, or joint-venture relationship.

5.2. You are solely responsible for reporting and paying all taxes (federal, state, local, and international) on your Fansit earnings. Where required by law, Fansit will issue a Form 1099-K, 1099-NEC, or equivalent international form. You must provide accurate tax information (W-9, W-8BEN, or equivalent) before receiving payouts.

6. Account Suspension & Termination

6.1. Fansit may suspend, restrict, or terminate your Creator account at any time and without notice for:

  • Violation of these Creator Terms or any policy referenced here.
  • Failure or refusal to complete or maintain verification.
  • Fraud, abnormal chargeback rates, or other risk signals.
  • Action required to comply with applicable law.

6.2. Effect of termination. Upon termination:

  • Pending earnings may be withheld for up to 180 days against potential chargebacks, fraud losses, and outstanding obligations, after which any net positive balance is paid to you (subject to thresholds and bank verification).
  • Forfeitable earnings include amounts attributable to fraudulent activity, content that violated zero-tolerance prohibitions, or amounts required to be remitted to chargeback claimants.
  • The §2257 record-retention obligations on Fansit (and the corresponding license under Terms § 6.2) survive termination.
  • Fan licenses to previously purchased content survive termination as described in Section 2.3.

7. Confidentiality

You agree to keep confidential any non-public information about Fansit's operations, security, finances, or business practices that you receive in connection with your Creator status.

8. AI Creators

8.1. Definition. An "AI Creator" is a Creator whose account features content that is generated, modified, or assisted by artificial intelligence, or whose persona is itself an AI character.

8.2. Designation. You must designate your account as an AI Creator before posting AI-generated content. AI Creators are subject to the same revenue terms, payout structure, and conduct rules as human Creators.

8.3. Disclosure. AI Creators must conspicuously label their profile, every post, and every individual piece of content as AI in accordance with AUP § 3.

8.4. Identity & likeness. AI Creators may only depict (a) a unique, fictional AI-generated identity, or (b) a real individual who has provided documented, revocable consent specific to the depiction. Depicting any other real, identifiable person — including public figures and celebrities — is prohibited regardless of any "fair use" or "parody" claim.

8.5. Legal responsibility. AI Creators remain fully responsible for compliance with copyright, right-of-publicity, defamation, and similar laws in every jurisdiction where their content is accessible. Fansit's use of automated tools to identify policy-violating synthetic content does not transfer that responsibility.

9. Anti-Trafficking Compliance

You confirm that no person depicted in your content is a victim of trafficking, coercion, or exploitation, and that all participants have provided free, prior, and informed consent. (See also our Anti-Slavery Statement.)

10. Independent Verification

Fansit may, at any time, request additional verification documentation, age- and consent-records for content you upload, and information necessary to maintain regulatory compliance. Failure to provide requested documentation within a reasonable timeframe is grounds for suspension.

11. Changes

Fansit may modify these Creator Terms at any time, with notice through the Platform or by email. Continued use of Creator features after the effective date constitutes acceptance.
