These Agency & Operator Terms govern the relationship between Astartus LLC and third-party agencies and operators who manage Creator accounts on the Fansit platform.

1. Definitions

  • "Agency" means a business entity that manages one or more Creator accounts on the Platform on behalf of Content Creators.
  • "Operator" means an individual who manages Creator accounts on behalf of an Agency or directly on behalf of a Creator.
  • "Managed Account" means a Creator account that is operated by an Agency or Operator rather than solely by the Creator themselves.
  • "Agency Principal" means the primary individual responsible for the Agency's registration and compliance with Fansit.

2. Agency Registration

2.1. Agencies must register with Fansit as an Agency entity before managing any Creator accounts on the Platform.

2.2. Registration requires:

  • The Agency Principal must complete full KYC verification (government-issued ID, liveness check)
  • Submission of Agency business documentation (business registration, tax identification)
  • Identification of all individual Operators who will have access to Managed Accounts
  • Agreement to these Agency Terms and all applicable Fansit Policies

2.3. All individual Operators with access to Managed Accounts must be identified and verified by the Agency. Fansit reserves the right to require individual KYC verification for Operators.

3. Managed Account Requirements

3.1. For each Managed Account, the following requirements apply:

  • The Creator must provide documented written consent for Agency management. This consent must be on file with both the Agency and Fansit
  • The Creator must complete their own KYC verification independently of the Agency. An Agency cannot complete KYC on behalf of a Creator
  • The Managed Account must be linked to the Agency's registration in Fansit's system
  • Revenue splits between the Creator and Agency are private arrangements outside Fansit. Fansit pays the Creator account directly per the Creator Earnings & Payout Policy

3.2. Creators may revoke Agency access at any time by contacting support@fansit.com. Revocation will be processed within forty-eight (48) hours.

4. AI Chat Operations

4.1. If Agencies use AI tools to manage chat or messaging on Creator accounts, this must be disclosed to Fans per the AI Content Disclosure Policy and Community Guidelines.

4.2. Agencies must identify which messages are AI-generated versus human-written, using the disclosure mechanisms defined in the AI Content Disclosure Policy.

4.3. Deceptive AI chat operations — where Fans are led to believe they are communicating directly with the Creator when the communication is handled by an Agency using AI or human chatters without disclosure — is a violation subject to enforcement action against both the Agency and the Managed Account.

5. Agency Obligations

5.1. The Agency must:

  • Ensure all Managed Accounts comply with Fansit's policies
  • Maintain accurate records of all Creators under management, including consent documentation
  • Report any suspected policy violations, exploitation, or coercion involving Managed Accounts
  • Not engage in any activity that constitutes or facilitates human trafficking, exploitation, or coercion
  • Maintain appropriate insurance and indemnification arrangements

6. Liability

6.1. The Agency is jointly and severally liable with the Creator for all content and conduct on Managed Accounts.

6.2. Fansit may take enforcement action against the Agency account, the Creator account, or both, at its sole discretion.

6.3. The Agency indemnifies Fansit against all claims, losses, and liabilities arising from Agency-managed content or operations.

7. Termination

7.1. All standard termination provisions apply.

7.2. Additional Agency-specific grounds for suspension or termination:

  • If the Agency's Managed Accounts collectively exceed a two percent (2%) chargeback rate over a thirty (30) day period, the Agency registration may be suspended
  • If three (3) or more Managed Accounts are terminated for policy violations within a ninety (90) day period, the Agency registration is automatically suspended pending review
  • If the Agency fails to maintain accurate records of Creator consent or Operator identification

7.3. Suspension of an Agency registration may result in temporary suspension of all Managed Accounts pending investigation.
