Fansit respects intellectual-property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). This Policy explains how to submit a DMCA takedown notice and a counter-notice for content you believe is infringing on Fansit. "Fansit" means Persona Payments LLC, dba Fansit, 1309 Coffeen Ave STE 1200, Sheridan, WY 82801.
1. Designated Agent
DMCA notices and counter-notices must be sent to our Designated Copyright Agent:
Jamie Wedow Designated Copyright Agent Persona Payments LLC, dba Fansit 1309 Coffeen Ave STE 1200 Sheridan, WY 82801 Email: dmca@fansit.com
Our Designated Agent is registered with the U.S. Copyright Office. The current registration is available in the USCO DMCA Designated Agent Directory.
2. Filing a DMCA Takedown Notice
If you believe content on the Platform infringes a copyright you own or are authorized to act for, send a written notice to our Designated Agent containing all of the following (per 17 U.S.C. § 512(c)(3)):
- Identification of the copyrighted work you claim was infringed (or, for multiple works, a representative list).
- Identification of the allegedly infringing material with sufficient detail to allow us to locate it — including the specific URL on the Platform.
- Your contact information — full legal name, mailing address, telephone number, and email address.
- A good-faith statement: "I have a good-faith belief that the use of the material complained of is not authorized by the copyright owner, its agent, or the law."
- A statement of accuracy under penalty of perjury: "I swear, under penalty of perjury, that the information in this notice is accurate and that I am the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
- Your physical or electronic signature.
We will not act on incomplete notices.
3. Counter-Notification
If you believe your content was removed in error, you may file a counter-notice containing all of the following (per 17 U.S.C. § 512(g)(3)):
- Identification of the removed material and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed by mistake or misidentification.
- Your full legal name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if outside the United States, the Federal District Court for the District of Wyoming, and that you will accept service of process from the person who provided the takedown notice or their agent.
- Your physical or electronic signature.
If we receive a valid counter-notice, we will forward a copy to the original notifier and may restore the removed content within ten (10) to fourteen (14) business days unless the original notifier files an action seeking a court order against you.
4. Repeat Infringer Policy
Fansit terminates, in appropriate circumstances, the accounts of users who are determined to be repeat infringers, in accordance with the DMCA. We use a strike-based system; the specific thresholds and review process are confidential to prevent abuse.
5. Misrepresentations
Knowingly making material misrepresentations in a DMCA notice or counter-notice is a federal offense and may subject you to liability for damages, costs, and attorneys' fees (17 U.S.C. § 512(f)). Submit false claims at your own risk.
6. Trademark, Right of Publicity, and Other IP Concerns
This policy covers copyright only. For trademark complaints, right-of-publicity violations, defamation, or other intellectual-property concerns, email legal@fansit.com.
7. Non-Consensual Intimate Imagery and Synthetic Content
If your concern involves the unauthorized use of your image, voice, or likeness in synthetic / AI-generated content, do not file a DMCA notice. Instead, email abuse@fansit.com for expedited handling under our Acceptable Use Policy. For non-consensual intimate imagery, see also our Content Moderation & Protection Policy.
8. Privacy
Information you submit in a DMCA notice or counter-notice may be shared with the user who posted the content at issue. Filing a notice or counter-notice is your authorization to do so.
9. Changes
We may update this Policy at any time. The "Last Updated" date reflects the most recent revision.
