This AI Likeness & Consent Policy governs the use of real individuals' likenesses in AI-generated content on the Fansit platform. It establishes requirements for consent, documentation, and enforcement to prevent unauthorized deepfakes and protect individuals' likeness rights.

1. General Prohibition

1.1. No AI-generated content may depict, replicate, or impersonate a real person without that person's documented consent on file with Fansit.

1.2. This prohibition applies regardless of whether the depicted person is a public figure, another Fansit Creator, or a private individual.

1.3. This prohibition applies to all forms of AI-generated depiction including images, video, audio (voice cloning), and text presented as being from or about the individual.

2. Consent Requirements

2.1. Before publishing any AI-generated content that depicts a real person's likeness, the Creator must:

  • Obtain a completed Fansit AI Likeness Consent Form (template available in the Help Center) or equivalent written consent document
  • Verify the identity of the consenting individual through government-issued ID
  • Complete a liveness check to confirm the consenting individual matches the ID provided
  • Submit the completed consent documentation to Fansit for review and record-keeping

2.2. The consent documentation must specify:

  • The full legal name of the consenting individual
  • The scope of consent: what types of content the likeness may be used for (e.g., images only, video, voice, explicit content)
  • The platforms on which the content may be published
  • The duration of the consent (specific end date or ongoing until revoked)
  • The individual's right to revoke consent at any time
  • The individual's signature (physical or electronic) and the date

2.3. Consent records must be maintained by the Creator and made available for platform audit upon request.

3. Self-Likeness

3.1. Creators may use AI to generate content based on their own likeness, provided:

  • They are the verified Account holder who completed KYC
  • The AI output is clearly labeled per the AI Content Disclosure Policy
  • The content does not misrepresent the Creator's actual appearance in a way that could constitute consumer deception

4. Deepfake Prohibition

4.1. Fansit maintains a zero-tolerance policy for non-consensual deepfakes.

4.2. Non-consensual deepfake content will result in:

  • Immediate removal of the content
  • Immediate and permanent ban of the Account
  • Forfeiture of all pending Creator Earnings
  • Referral to law enforcement where applicable

4.3. Content flagged by automated systems as a potential deepfake will be removed pending human review. The Creator will be notified and given an opportunity to provide consent documentation.

5. Minor Protection

5.1. AI-generated individuals that appear to depict minors are strictly prohibited regardless of whether a real minor is depicted.

5.2. The visual assessment standard applies: if an AI-generated individual could reasonably be perceived as being under 18 by a reasonable person, the content is prohibited.

5.3. Prompt text, disclaimers, metadata, or textual age assertions (e.g., "this character is 25 years old") cannot override the visual assessment.

5.4. Borderline cases will be reviewed by a panel of at least three (3) moderators. If two or more moderators determine the depicted individual could reasonably be perceived as under 18, the content will be removed.

6. Revocation of Consent

6.1. Any individual who has previously granted consent for their likeness to be used in AI content may revoke that consent at any time by contacting support@fansit.com.

6.2. Upon verified revocation, Fansit will notify the Creator and require removal of all content featuring the individual's likeness within seventy-two (72) hours.

6.3. Failure to remove content after consent revocation will result in content removal by Fansit and enforcement action against the Creator.
